MUMBAI: With the post of Maharashtra advocate general(AG) lying vacant for over eight months, the Bombay high courton Monday asked the state when it will make an appointment to the constitutional post. A division bench, headed by Justice Abhay Oka, asked the state government to file its affidavit before the next date of hearing on December 14, 2016 mentioning the outer limit by when it will appoint the AG.

The court is hearing a petition filed by Congress MLC Sanjay Dutt, seeking directions to the state to appoint a new advocate general. The petition claimed that the post of acting advocate general was "unconstitutional". Rohit Deo had been appointed the acting advocate general after the former advocate general S H Aney resigned in March 2016. The HC had at an earlier hearing remarked that in another matter, the state had said that it would appoint an advocate genera shortly.
